On 23 May 2024, Estonia issued Presidential Decree No. 410 amending the Food Act with effect from 1 July 2024. The main amendments include:
(1) the addition of "The legal representative of a food business operator shall organise the fulfilment of obligations under this Act" to Article 6, paragraph 1, and the repeal of Article 19, paragraph 3, sentence 2, which states that "The competent authority shall establish a procedure for state regulation of contaminants to ensure the safety of food of animal origin"; (2) the amendment of the Food Act by the Presidential Decree No. 410 of May 23, 2024, is effective as of July 1, 2024. ";
(2) Article 21 is added to authorise the use of ionising radiation for the treatment of foodstuffs, which requires a permit from the competent authority, and in order to obtain a permit for the treatment of foodstuffs by ionising radiation, the handler shall submit a written application accompanied by information on the foodstuffs to be treated, the purpose of the treatment, and data on the source of the radiation, etc., and the decision on whether to grant a permit or not shall be made within 20 working days from the date of acceptance of the application, and when the applicant does not have a photo of the radiation practising, submits false information, or the irradiation treatment does not meet the conditions drawn up by the Act, the permission shall be refused;
(3) Article 65 adds requirements for the licensing of enterprises that have been approved by the Agri-Food Department for the use of irradiation treatment of foodstuffs prior to the official entry into force of the Regulation.
